  • UK: Consumer Rights Act 2015, Data Protection Act 2018, UK GDPR, and VAT regulations.
  • USA: FTC Act, DMCA, state-specific consumer protection laws, and sales tax regulations.

2. Product Listings

2.1. Allowed Products: All products listed must be digital game keys or related digital content. Physical products are not allowed.
2.2. Product Descriptions: Sellers must provide accurate and complete product descriptions, including:

  • Platform compatibility (e.g., Steam, PlayStation, Xbox, Nintendo).
  • Region restrictions (if applicable).
  • Language support.
  • System requirements (if applicable).
  • Valid and unused game keys.
    2.3. Prohibited Items: Sellers must not list the following:
  • Counterfeit or pirated goods.
  • Fraudulently obtained keys.
  • Products violating intellectual property rights.
  • Products promoting violence, hate speech, or illegal activities.
  • Products that infringe on trademarks, copyrights, or patents.
    2.4. Intellectual Property: Sellers must ensure they have the legal right to sell the products listed on the platform.

3. Pricing and Payments

3.1. Pricing: Sellers are responsible for setting competitive and fair prices for their products.
3.2. Taxes and Fees: All prices must include applicable taxes, fees, or charges unless otherwise stated.

  • EU/UK: VAT must be clearly displayed for customers in the EU and UK.
  • USA: Sales tax must be applied where required by state laws.
    3.3. Payment Processing: Payments to sellers will be processed according to the platform’s payment schedule, minus any applicable fees.
    3.4. Currency: All transactions will be conducted in USD, Sellers are responsible for any currency conversion fees.

4. Order Fulfillment

4.1. Delivery: Sellers must deliver valid and unused game keys immediately after purchase.
4.2. Order Issues: Sellers are responsible for resolving any issues related to invalid or non-functional keys.
4.3. Penalties: Failure to fulfill orders may result in penalties, including account suspension or termination.


5. Refunds and Returns

5.1. Refund Policy: Sellers must comply with the platform’s refund policy and applicable consumer rights laws:

  • EU: Customers have a 14-day cooling-off period for digital purchases, during which they can cancel their order and request a refund, provided the key has not been redeemed.
  • UK: Customers have the same 14-day cooling-off period under the Consumer Rights Act 2015.
  • USA: Refund policies must comply with FTC guidelines and state-specific laws. Sellers must clearly state their refund policy on their product pages.
    5.2. Refund Reasons: Refunds will be issued for:
  • Invalid or non-functional keys.

  • Manipulating reviews or ratings.
    6.2. Intellectual Property: Sellers must not violate intellectual property rights or infringe on trademarks, copyrights, or patents.
    6.3. DMCA Compliance (USA): Sellers must comply with the Digital Millennium Copyright Act (DMCA) and similar copyright laws in the EU and UK.

7. Compliance with Google Merchant Center Policies

7.1. Google Policies: Sellers must adhere to Google Merchant Center’s policies, including:

  • Providing accurate product data.
  • Ensuring transparent pricing and fees.
  • Complying with Google’s prohibited content guidelines.
    7.2. Prohibited Content: Sellers must not list products that violate Google’s policies, such as:
  • Products promoting violence, hate speech, or illegal activities.
  • Products with misleading or deceptive claims.

8. Data Protection and Privacy

8.1. Data Protection Laws: Sellers must comply with data protection laws in all applicable jurisdictions:

  • EU: General Data Protection Regulation (GDPR).
  • UK: Data Protection Act 2018 and UK GDPR.
  • USA: California Consumer Privacy Act (CCPA) and other state-specific privacy laws.
    8.2. Personal Data: Sellers must not collect, store, or process personal data of buyers without their explicit consent and a lawful basis for processing.
    8.3. Third-Party Services: Sellers must ensure that any third-party services they use for order fulfillment or payment processing are also compliant with data protection laws.

9. Liability and Indemnification

9.1. Seller Responsibility: Sellers are solely responsible for their products, listings, and transactions.
9.2. Indemnification: Sellers agree to indemnify and hold 4CDK.com harmless from any claims, damages, or losses arising from their actions or violations of these terms.


10. Termination

10.1. Platform’s Right to Terminate4CDK.com reserves the right to suspend or terminate seller accounts for violations of these terms or platform policies.
10.2. Seller’s Right to Terminate: Sellers may terminate their account at any time by providing written notice.


11. Governing Law and Dispute Resolution

11.1. EU: For EU sellers and customers, these terms are governed by the laws of The EU.
11.2. UK: For UK sellers and customers, these terms are governed by the laws of England and Wales.
11.3. USA: For USA sellers and customers, these terms are governed by the laws of the State of New York, without regard to its conflict of law principles.
11.4. Dispute Resolution: Any disputes arising from these terms will be resolved through arbitration or in a court of competent jurisdiction.

  • EU: Customers may use the Online Dispute Resolution (ODR) platform provided by the European Commission.
  • USA: Disputes may be resolved through binding arbitration in accordance with the American Arbitration Association (AAA).
